Court to hear Obama eligibility challenge on merits, first time!

“This will be the first time ever, since this whole thing began, that it will be looked on, on merit.” Those are the words of Carl Swensson, Republican Party Chairman of Clayton County, Georgia. “This” refers to an actual judicial hearing of the case against the eligibility of Barack Hussein Obama, Jr. to be, according to the United States Constitution, “Commander in Chief” and United States President.
The attorneys of Barack Obama requested a pretrial dismissal, as it had done on so many other occasions, against so many other cases. But yesterday, one judge denied and scheduled an official hearing of the case to commence, January 26.

From 2008 to the present, judicial standing has been refused the plaintiff, often via convoluted rationale, many say sophistry. The question however is elementary to our constitutional republic: can we as Citizens be assured those presented to us for our votes are eligible to hold office?
Unlike many other states, Georgia has a statue requiring just that. For Swensson’s part, he had “resolved that I would not let anyone on the ballot who is not demonstrably qualified to hold that office.” That would appear to be part of his job as party official and it is the job of Georgia’s Secretary of State, Brian Kemp (R) to assure election law is justly carried out. Swensson relates, “We have been hounding him at hearings he’s been having across the state.”
And so it came to pass that Kemp after some delay, followed due process and called forth the court designated by Georgia law, to hear such a case. This particular case was brought by Swensson and co-litigant, Kevin Richard Powell, attorney: J. Mark Hatfield, judge: Michael M. Malihi.
As veteran Obama eligibility beat reporter Bob Unruh details at WND.com:
- While Obama’s attorney, Michael Jablonski, had argued that the requirements didn’t apply to candidates for a presidential primary, the judge said that isn’t how he reads state law.
“Statutory provisions must be read as they are written, and this court finds that the cases cited by [Obama] are not controlling. When the court construes a constitutional or statutory provision, the ‘first step … is to examine the plain statutory language,” the judge wrote. “Section 21-2-1(a) states that ‘every candidate for federal and state office’ must meet the qualifications for holding that particular office, and

Swensson and Powell’s is one of three cases, Unruh again:

They were brought against Obama’s inclusion on the 2012 election primary ballot by David Farrar, Leah Lax, Cody Judy, Thomas Malaren and Laurie Roth, represented by attorney Orly Taitz; David Weldon represented by attorney Van R. Irion of Liberty Legal Foundation; and Carl Swensson and Kevin Richard Powell, represented by J. Mark Hatfield.

A former secretary of state, Karen Handel, utilized the law when she disqualified someone from his candidacy for local office.
This was one of three rulings of Mahili on these matters, yesterday. Another separated these three cases, at the request of the plaintiffs, which he had earlier lumped together into one. Swensson respectfully explained that the integrity of his particular case required separation from the methods of at least one other case’s attorney, Orly Taitz. And as for his own attorney, about their own particulars, “Mark has been doing a Hell of a job.” (statement left unvarnished since the job of doing Hell is one of God’s own works of justice, as such, due respect).
Yesterday’s remaining ruling denied an early deposition to the plaintiffs, a move which may have brought a sense of bargaining power to the proceedings, when faced up to the Obama request for dismissal. While the manipulated mainstream media’s “birther” blackout and ridicule campaign is expected to continue, many eyes will focus on Judge Mahili’s court, come January 26. Finally, the definition of Article II’s “natural born Citizen” will be discussed, regarded at the time and upheld by the Supreme Court in Minor v. Happersett, as requiring both of a president’s parents to be U.S. Citizens, by the study of numerous scholars of constitutional language and original intent. (Link — Link)
And the quest for the truth of Barack Obama’s birth certificate will finally be put to the court as well, his Donald Trump induced 2011 submission being deemed a forgery by numerous experts of electronic document renderings. (WebSearch Link)
The journey to this milestone has been arduous to the Citizen activists involved and costly to us, the taxpayers, footing Obama’s legal bills. About his own involvement, Swensson relates, “We’ve been in this battle… for three years…”
It is also costly to the pocketbooks of the plaintiffs and their attorneys. After prompting, Swensson further confesses, “I could definitely use the help of like minded patriots who want Obama removed from the ballot, if and only if he is not qualified to be there in the first place.” (Swensson’s site, Rise up for America)

Sheriff Joe Arpaio came up with the idea to demand the original microfilm of Obama’s birth certificate after he saw evidence from his Cold Case Posse in Maricopa County, Ariz., that the White House apparently released to the public three different versions of the long-form birth certificate.
“Show me the microfilm, not the copies the White House released,” Arpaio has insisted.
What the White House released on April 27 were not original documents but purportedly scans of original birth documents that remain in the Hawaii Department of Health vault.
WND reported yesterday that in 1966, the Hawaii Depatment of Health provided microfilm copies to Mrs. Eleanor Nordyke of the birth certificates for her twins, born the day after Obama in the same hospital.
“Obama’s birth certificate is either on that microfilm roll along with the Nordyke twins’ birth certificate, or it’s not,” Arpaio said.
Sources close to the sheriff’s law enforcement investigation explained to WND that Arpaio had come up with a solution to end almost immediately a controversy over the Obama birth certificate that has continued since 2008.
“If the microfilm exists, show us the reel. That’s the best evidence the document existed in 1961, not the three different versions the White House released on April 27.”
The White House released three versions of Obama’s long-form birth certificate, each one of which appears fundamentally different from the other two.
If the long-form birth certificate the White House released was merely a scan of an original document held in the Hawaii Department of Health, critics ask, then why are the three different in appearance?
On the morning of April 27, the White House posted on its website a document purporting to be a scan of the original 1961 Obama birth certificate obtained from the vault records of the Hawaii Department of Health.
As seen in Exhibit 1, the version of the birth certificate first displayed by the White House to the American public was an electronic PDF computer file that contained a green background clearly showing the green hash-marks of Hawaii Department of Health security paper. This is the first in a two-part series examining how researcher Ron Polland created a forged duplicate of the Obama long-form birth certificate released April 27 by the White House. This article details the methodology Polland used to deconstruct the White House document for the purpose of reconstructing his forged version. The second article will examine Polland’s belief that the White House document was forged and his deductions about the alleged forger.
Researcher Ron Polland, known for his forensic investigation of Barack Obama’s short-form birth certificate, now has constructed from scratch a duplicate of the document released by the White House in April, seeking to validate his contention that it was created by a forger.
“I created Obama’s short-form birth certificate in 2008,” Polland told WND, “and now I made Obama’s long-form birth certificate.”
As WND previously reported, Polland has demonstrated that during the 2008 presidential election campaign, the White House website posted an image of a short-form Obama Certification of Live Birth that actually was a forgery created by Polland, not a scan of an original certificate obtained from the Hawaii Department of Health.
“My recreation of the short-form was so convincing, the White House posted it on the White House website, claiming it was the real deal,” Polland told WND. “In August 2008, I successfully duplicated the short-form in what I believe is the only way it could have been made. Now I have re-created the long-form with a forgery of my own that I believe most people will find hard to distinguish from the forgery the White House released.”
Polland has worked virtually non-stop for the last two months to deconstruct the long-form birth certificate posted on the White House website to determine precisely how it was constructed. His effort was the first step in the process of producing his own forgery of the Obama birth document.
Since April 27, WND has published the analysis and testimony of more than 20 computer and imaging experts who have demonstrated anomalies in the White House-released long-form birth certificate. Some believe the document is a forgery.
“To prove to my satisfaction that the long-form birth certificate was forged, I had to understand precisely how each anomaly was created,” Polland said, “and then I had to be able to use these techniques to produce a forgery of my own. I had to put myself in the forger’s shoes to figure out what he was trying to accomplish and why he made it look the way he did.”
Polland’s standard was that his forgery had to be good enough that most observers would find it hard to tell it apart from the image the White House released.
“My results confirm that the PDF document is a one-of-a-kind image forgery meant to resemble a birth certificate document but with flaws and complexities purposely added to lead investigators down blind alleys and dead ends,” he said. “In short, this PDF document was never intended to be a genuine copy of an actual Hawaii State certified birth certificate.”
For comparison purposes, Exhibit 1 shows the long-form birth certificate released by the White House, while Exhibit 2 shows the recently completed Polland forgery.

The easiest way to distinguish the Polland forgery from the White House-released document is to observe that the date of the registrar’s stamp in Polland’s forgery is March 15, 2011, while the date of the stamp in the White House document is April 25, 2011.
